The General Product Safety Regulation (“GPSR”) aims to ensure the sale of safe products to buyers in the European Union and Northern Ireland (collectively “EU”).

It will come into effect on 13 December 2024.

You may be required to meet the GPSR requirements if you sell new or second hand non-food products to consumers in the EU. The European Commission has indicated that the scope of the GPSR may include “digital products, including software.” See Obligations for business.

The GPSR requirements are, among other things, as follows:

  • Ensure all products you sell in the EU meet existing labelling and traceability requirements.

  • Have an EU Responsible Person for those products, if you / the manufacturer are not located in the EU.

  • Label the products with the contact information of the Responsible Person, the manufacturer and, if applicable, the importer

  • Label products with type, batch or serial number.

  • Label products with safety information and warnings, where applicable, in the language of the country of sale.
